Terms of Service

Archetype is operated by Viral Labs LLC, a Colorado limited liability company, 458 Trailhead Road, Monument, Colorado 80132. You can reach us at support@archetype-leads.com. "Archetype", "we" and "us" mean Viral Labs LLC. "You" means the person or business using the service.

By creating an account you agree to these terms. If you are agreeing on behalf of a company, you confirm you are authorized to bind that company.

Archetype helps you build marketing lists, write outbound email sequences, send them through your own connected mailboxes, and manage the replies. We supply software and, where you choose to buy it, marketing data licensed from third-party data providers.

We do not send email on your behalf from our own domains, and we do not review, approve, or take responsibility for the content of your campaigns.

Lead sourcing, enrichment and AI features are paid for with prepaid credits. Credit prices and the per-lead rate for each data source are shown in the app before you confirm an order. Credits are drawn down as work completes.

Credits are non-refundable and have no cash value. Subscription fees, where applicable, are billed in advance and are non-refundable for partial periods. You can cancel a subscription or delete your account at any time from Settings.

Payments are processed by Stripe. We never see or store your full card details.

Lead records you purchase through Archetype are licensed to you, not sold. Our data providers place binding conditions on that data, and by ordering records you agree to the following. These restrictions pass through to anyone you share the data with, including your own clients, and you are responsible for their compliance.

You may:

• Use purchased records for direct marketing — your own and your clients'.
• Store, combine, analyze and re-use purchased records indefinitely.
• Export records and load them into your own CRM or tools.

You may not:

• Resell, license, broker, trade or contribute the data as data to any list broker, compiler, data co-operative or identity graph.
• Use the data for any purpose reserved to consumer reporting agencies — deciding eligibility, terms or pricing for credit, insurance, housing, tenancy or employment. Insurance, credit, housing and real-estate use is limited to selecting and addressing marketing.
• Combine the data with selections based on race, color, religion, national or ethnic origin, sex, familial status, disability or receipt of public assistance when marketing insurance, credit, housing or real-estate products.
• Tell a recipient, or imply in any message, that they were contacted because of an intent signal, score, search history or similar data about them. Write about the subject, never about the signal. Archetype screens outgoing copy for this and will rewrite or block messages that breach it.
• Attempt to re-identify, reverse-engineer or replicate a provider's data sources, scoring models or database.
• Use the data in breach of the TCPA, CAN-SPAM, state telemarketing and privacy laws, or Do Not Call rules.

Intent data and intent scores are licensed only while your account is active. If your account closes, you must stop using them and delete them within 30 days. Ordinary purchased records are yours to keep.

Record counts shown before an order are estimates, not a guarantee of deliverable volume. If records are materially wrong for the order you placed, tell us within 30 days of delivery and we will pursue a replacement or credit from the provider.

You are solely responsible for every message sent from your connected mailboxes: who you contact, what you say, and when. You agree to identify yourself truthfully, include a working opt-out in every message, honor every opt-out and deletion request promptly, apply your suppression list to every campaign, and comply with CAN-SPAM and all other applicable law.

Archetype provides the compliance footer, unsubscribe handling and suppression tools, but using them correctly is your responsibility.

You may not use Archetype to:

• Send deceptive, fraudulent, adult, or malware-bearing content.
• Market online casino, sports betting or other gambling offers.
• Impersonate another person, business, bank or government agency.
• Market Medicare or health-insurance products using purchased intent data by email.
• Harass any individual or contact anyone who has opted out.
• Share your account credentials, or resell access to the platform itself.

We may suspend or terminate an account immediately for a breach of this section, for unlawful use, or where continued use threatens the security of our systems or our standing with our data and sending partners.

Archetype uses AI models to draft copy, transcribe uploads, classify replies and score leads. AI output is a draft, not advice, and can be wrong. You are responsible for reviewing anything before it is sent. You can opt out of AI features in Settings or by contacting support.

You keep ownership of your account data, your lists, your uploads and your campaign content. You grant us the limited right to host and process it so we can provide the service. We keep ownership of Archetype itself. Our Privacy Policy explains how we handle personal information.

We work to keep Archetype available, but the service is provided "as is". We do not warrant uninterrupted operation, the accuracy or completeness of third-party data, or any deliverability, response or revenue outcome. Intent scores are probabilistic indicators, not statements of fact about any individual.

Neither party is liable for indirect, incidental, special or consequential loss, or loss of profits, revenue or data. Our total liability is capped at the amounts you paid us in the twelve months before the event giving rise to the claim. Nothing here limits liability that cannot be limited by law.

You will defend and indemnify us against third-party claims arising from your use of lead data or from marketing communications sent by you or your clients.

You can cancel your subscription or delete your account at any time from Settings. Deleting your account removes your data from our systems, other than records we must retain for billing, tax or legal reasons. Either party may terminate at any time; your obligations in sections 4, 5, 6, 8 and 10 survive.

We may update these terms. Material changes will be notified by email or in the app at least 30 days before they take effect. Continued use after that date means you accept the updated terms.

These terms are governed by the laws of the State of Colorado, without regard to its conflict-of-laws rules. Disputes will be resolved in the state or federal courts located in Colorado.
